Defective products result in thousands of injuries in the United States every year. If the negligence of a product’s manufacturer or seller places a defective product in a consumer’s hands, they may be deemed liable for injuries or damages under product liability law. A product’s defects may occur during the design process, manufacturing process, or in the way the product was marketed. If you have been injured due to a faulty or defective product, you may be entitled to compensation for your injuries and any property damage. Contact Kirk Law Firm, PLLC today.
Who is Liable for a Defective Product?
If a faulty or defective product results in injuries or property damage, responsibility could lie with several different parties within the product’s manufacturing and distribution chain. These parties may include the manufacturer of the product, the manufacturer of component parts, the product’s assembler or installer, the wholesaler, or the retail store that sold the finished product.
Types of Defective Products
Three categories of product liability exist that could result in injury or property damage. These include:
- Defects in the product’s design – These occur before the product is even manufactured.
- Defects in the manufacturing process – These occur when a problem in the product’s assembly causes a defect.
- Defects in the marketing of the product – These are the result of a product that is marketed in an improper or dangerous manner, including improper or insufficient labeling and safety warnings.
Some products are inherently unsafe and claims of injuries suffered while using these products are rarely successful. For example, a product such as an electric knife can easily cut someone causing serious injuries, however, if the knife is too dull to injure someone it will likely be useless for its indicated purposes as well. Even so, manufacturers of such products are required to provide labeling that warns of the risks of using their product.
Product liability claims are incredibly complex and often require expert testimonies to get beyond the initial stages. For starters, there are many parties involved in the manufacturing and distribution chain and determining who is at fault is rarely an easy task. Additionally, myriad defenses exist that companies may use to fight a claim against them. Finally, each state has specific laws and statutes regarding product liability claims. Having an experienced product liability attorney can be the difference between a complete dismissal of your case and a substantial award for damages.

What our clients are
I would like to say the Kirk Law Firm went above and beyond their duties as my attorney. I searched long and hard to find an attorney to take my case. After being turned down by 4 of the larger Law Firms in the Dallas/Ft Worth area I contacted the Kirk Law Firm and they were meeting with me the following morning. They did a fantastic job representing me and got me a larger settlement than I had ever dreamed of. They are a great group of Attorneys.

I was represented by the kirk lawfirm, a couple of year ago. I was injured on the job, back in February 2017. Which caused me head trauma and 2 surgeries for torn rotator cuff, which wasn't successful. I was worried about, what my future would be like. Being in my 60,s. I am married and just adopted my grandkids. I was looking for a lawyer and was fortunate to have stumbled upon, Dana Kirk and his lawfirm. I and my family were treated with compassion and respect. From his personal secretary to his associates all were very professional and knowledgeable about injury law. They negotiated a settlement for me, which has made me able to take care of my family. I highly recommend them and I'll always think of them as friends, who gave me my life back.
